SERVICES & CHARGES

The Bailiffs Office Brisbane offers a number of services on a fee pay basis. Bailiffs fees are regulated by legislation and in most cases are GST exempt.

The Bailiffs Office will accept process which is to be served in the following Court Districts in South East Queensland :

Any process received at the Bailiffs Office Brisbane, which is to be served in any other Court District in Queensland will be forwarded onto the Bailiffs Office of the relevant Magistrates Court where the process is to be served.

Services Offered by the Bailiffs Office Brisbane

Enforcement and Execution of various Civil Warrants issued by Magistrates Courts in Queensland, and transferred to Brisbane for enforcement within that Court District.

Service of Civil Process in the greater Brisbane Area and surrounding Districts.

Service and Execution of process and Warrants issued out of the Small Claims Tribunal at Brisbane.

Service of Various Process on behalf of persons in disputes being dealt with by the Building Tribunal and the Rental Tenancy Authority.

Service of Interstate Process received from parties, issued out of any Jurisdiction within the Commonwealth for service in the greater Brisbane area.

Service of Family Court of Australia Process and documents issued for service by that Court in the greater Brisbane area, and service of various applications and orders on behalf of parties requiring such service.

Safe hand delivery of confidential and Important Documents, other than Court Process.

The bailiffs’ office can arrange Hand to Hand personal delivery of confidential / important documents that are required to be delivered from one party to another. This service can ensure that important documents are delivered to another party without delay, and only to the party concerned, within the same business day, if possible.

The Bailiffs Office can be contacted by phone during business hours, by fax or by email, for any general enquiries regarding service of any process, at any location in Queensland and for advices as to service in other states.

Attendance at Enforcement hearings on behalf of a Creditor

The Bailiffs Office can arrange, on behalf of a Creditor, for a Suitably Qualified Agent to appear at an Enforcement hearing and undertake the Verbal enquiry of a Debtor at that hearing. Prior notice of at least 24 hours before the appearance is preferred to ensure a suitable agent is available but last minute requests will be attended to if an agent can be contacted.

Effective Service

  • The Bailiffs of the Magistrates Court are appointed Officers of the Magistrates Court and as such are required by their office to conduct their duties of office in accordance with the Rules of the Court.
  • Service of all process and execution of matters coming before them will be handled in an ethical manner in accordance with the Court Rules and without favour to any party and in an impartial manner.
  • Service and execution of all process will be attended to without delay and fees charged will be only that which is allowed by law.
  • Multiple attempts at service and execution will be made at no additional cost to the client, so as to effect service/execution or until it can be confirmed that the matter cannot be bought to conclusion.
  • A full Affidavit of Service or a full Report as to non service/execution will be returned to the parties concerned outlining the reasons that the matter could not be served or executed and suggesting alternative actions that can be enforced in accordance with the Rules of the Court. (There is no cost for an Affidavit of Service or written report to an action)


  • Points to consider, to assist with prompt and effective service of process.

    1. Process that requires service, after being filed and sealed by the Court of issue, should be forwarded to the Bailiffs Office Brisbane (see areas covered by Brisbane Bailiffs Office) or to the Bailiff of the Magistrates Court District where the party to be served can be located.

    2. To ensure prompt service and speedy return of the Affidavit of Service, there must be a sealed copy of the action for each party to be served plus an additional copy to allow completion of the affidavit of service (the additional copy may be a photocopy of the action:
    Example One defendant to be served, requires 1 x sealed copy of matter for service + 1 x Copy to complete affidavit of service. For each additional person to be served requires an additional copy. The additional copy will be returned to the Plaintiff with the affidavit of service completed and attached.

    Correct address of service

  • Ensure the address of service is correct and complete and if the action is hand written, all details are legible.
  • Include with the process a note giving any information that may assist in the speedy location of the person to be served, such as:
  • Directions to the address of service, if the address is known to be difficult to locate.
  • Information, if known, as to when is the most likely time to find the Defendant at a given address.
  • Any information that may assist the bailiff to locate the defendant without undue delay.


  • Time Frame to effect service of process

    The Bailiffs Office Brisbane organizes service of process on a daily basis, covering all Court Districts within the greater Brisbane and surrounding areas. Service is carried out 7 days a week except when service is prohibited by Law (Christmas Day and Good Friday)

    Process for service will be attempted within 24 hours of receipt and if not served further attempts will be made at various times day and night until service is effected or it is confirmed that service can not be accomplished by normal means. Normally service is affected and the completed affidavit of service is returned to the Plaintiff within 10 working days.

    Service Fees

  • Ensure the correct service fee is included with documents for service. Any Magistrates Court can advise the correct service fee for any locality in Queensland and the fee should be included in the costs to the action and can be claimed as part of the Judgment Debt.   • Bailiffs' service fees may be paid at the Bailiffs Office Brisbane by cash or cheque during business hours or if process is sent by post a Cheque or Money Order made out to “Bailiffs Office” should be enclosed with the process. A receipt for fees will be returned to the person lodging documents.
  • Service documents for service, in the same Court District where the documents are filed, may be left at the Court with the appropriate service fees in a sealed envelope for collection by the Bailiff.
